Terms of Service

1. Acceptance of Terms

By accessing or using SecureClear ("the Service"), operated by NSSG Consulting, you agree to be bound by these Terms of Service. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these terms. If you do not agree, do not use the Service.

2. Description of Service

SecureClear provides automated external security posture assessments for internet-facing domains. The Service evaluates publicly accessible signals including SSL/TLS configuration, DNS records, HTTP security headers, and related indicators to produce an insurability score and remediation guidance.

Scanning scope: All scans are performed against publicly reachable infrastructure only. SecureClear does not require, request, or obtain access to your servers, internal networks, source code, or credentials. Scan results are informational and do not constitute a comprehensive security audit or penetration test.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorised use of your account. NSSG Consulting will not be liable for any loss resulting from unauthorised use of your account.

You may only scan domains that you own, operate, or have explicit written permission to assess. Scanning domains without authorisation may violate applicable law and will result in immediate account termination.

4. Acceptable Use

You agree not to:

  • Use the Service to scan domains without authorisation from the domain owner.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated means to abuse free-tier scanning limits or circumvent rate limits.
  • Resell or sublicense access to the Service without prior written consent.
  • Use the Service to facilitate illegal activities or violate third-party rights.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.

5. Free Tier and Paid Plans

The free public scanner ("Free Tier") provides a limited number of scans per IP address per hour. Free Tier results are provided without warranty and may be subject to throttling.

Paid portal plans ("Professional", "Enterprise") provide higher scan quotas, team seats, monitoring, and outreach capabilities as described on the pricing page. Paid plans are billed monthly or annually via Stripe. Subscriptions auto-renew unless cancelled before the next billing date. Refunds are not provided for partial billing periods.

New accounts receive a 14-day Professional trial. At the end of the trial, accounts downgrade to the Free plan unless a paid plan is activated. No credit card is required to start a trial.

6. Intellectual Property

The Service, including all software, algorithms, interfaces, and content, is the exclusive property of NSSG Consulting and is protected by copyright and other intellectual property laws. These terms do not grant you any ownership rights in the Service.

You retain ownership of any data you submit to the Service (e.g. domain lists, company information). You grant NSSG Consulting a limited licence to process that data solely to provide the Service.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Scan results are informational only. SecureClear does not guarantee that a high insurability score will result in insurance approval, specific policy terms, or any other business outcome. The score reflects external observable security signals at the time of the scan and may not reflect all vulnerabilities.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NSSG CONSULTING'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100. IN NO EVENT SHALL NSSG CONSULTING BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Termination

Either party may terminate the agreement at any time. You may delete your account from the Settings page. NSSG Consulting may suspend or terminate your access for breach of these terms, non-payment, or abuse, with or without prior notice.

Upon termination, your right to access the Service ends immediately. Churned account data is retained for 90 days to facilitate recovery requests, then permanently deleted. You may request immediate deletion at any time from the Settings page.

9. Changes to Terms

We may update these terms from time to time. Material changes will be notified by email to the admin on file. Continued use of the Service after the effective date of revised terms constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the jurisdiction in which NSSG Consulting is registered. Disputes shall be resolved by binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
